Access to Health Hero is via a portal which can be found online.
7. Personal Training Agreements
7.1 Personal Training sessions (which are offered on one-on-one, pairs, or small groups bases) are provided by registered personal trainers ("PTs") at our gyms, who each operate as an independent contractor; our role in this regard is limited to a location where the PT can train members of the particular gym location.
7.2 Should you choose to engage in Personal Training sessions, you will enter into a separate contract directly with the PT, which is independent of your membership Contract with us. The cost of any Personal Training sessions purchased by you is in addition to the cost of your standard membership package with us. Any refunds, cancellations, or other disputes arising from your contract with your PT should be addressed directly to your PT; NRG Gyms are not responsible for the provision of the PT services, and therefore we accept no liability (except for any liability that cannot be limited or excluded under law) in relation to the provision of PT services in our gyms.
8. Special Promotions
8.1 We will offer special Promotions to current and new members at selected gyms from time to time, including discounted introductory rates, prepaid multi-month offers, joining fee waivers, promotional upgrades, and "Refer-a-Friend". Current and new members may be offered special Promotions unless an existing Promotion is currently active on your membership account. These terms and conditions will apply for any existing or new members engaging with our Services via a Promotion both during the promotional offer period and thereafter, should you continue to use our Services after the Promotion ends.
8.2 We reserve the right to withdraw or amend a Promotion prospectively from some or all of our gyms. This will not affect any Promotions already applied or earned.
8.3 A Promotion applies only to the membership type, gym(s), and period stated at sign-up, cannot be combined with any other offer unless stated, and has no cash value.
8.4 Where a Promotion reduces your fee for part of your term, your standard fee will apply automatically once that period ends, and your minimum term and standard cancellation terms (Cancellation Period Section) continue to apply in full.
8.5 Where a joining fee is waived under a Promotion, this applies only to your original sign-up and not to any later rejoin, upgrade, or transfer.
8.6 Refer-a-Friend promotion: referring member will receive 1 month’s free membership.
8.7 For the referring member to qualify for a free month of membership the referred member must have started their second month of membership and have no debt on their account.
9. Accessing the Gym
9.1 To access the gym, you must use the QR scanning function on the App that must be downloaded to your own mobile device with location services enabled. If you have accessibility needs and cannot use our turnstiles, the gym manager may issue a pin access code at their discretion, acting reasonably and proportionately.
9.2 If you are unable to use the App for another reason, you agree to only access the gym during staffed hours where you can be manually signed in upon arrival.
9.3 If you are issued with a pin access code this is issued solely for your use, and you must not let any other Member or non-member use your pin access code to access the site.
9.4 You are responsible for keeping your pin access code secure and confidential at all times.
9.5 In the interests of the safety and security of all our Members, use of pin access codes and QR code scanning are monitored, and individuals may be asked to provide proof of identification and your active membership details
9.6 If we have reasonable grounds for believing that you knowingly provided your pin access code or own mobile device to another individual or individuals or allowed unauthorised entry following your entry to the gym (e.g. Pin or device sharing):
(a) we reserve the right to cancel your Contract with immediate effect, and/or to charge you an administration fee of £30.00 for a first offence, rising to £50.00 for a second offence, reflecting our reasonable administrative costs.
(b) we may hold you responsible for the conduct of such individual(s) while at such site and hold you liable for any loss we suffer as a consequence of that conduct.
9.7 Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice (see below). We will not be liable if for any reason our site is unavailable at any time or for any period.
9.8 To help ensure the safety of our members and staff, You must comply with all policies, safety measures, instructions and signage in place at our gyms, which includes any signage relating to member conduct, the use of our facilities, and health and safety requirements. You must also comply with our policies and safety measures set out at https://nrggym.com/train-with-confidence/, as updated or amended from time to time.
9.9 You confirm that you have an adequate level of fitness and sufficient knowledge to train safely in an NRG Gym, including use of the gym equipment (and free weights). Where you do not have sufficient knowledge, you will take an induction course from a member of the NRG staff before using the gym or relevant equipment. Whilst our staff regularly inspect the safety of our gyms and its equipment, you should take reasonable care to check that any equipment appears to be in a safe and suitable condition before use, and you should notify a member of our staff promptly if you become aware of, or suspect, any defect, damage or other issue with our equipment.
9.10 We may temporarily close or restrict access to certain areas of our gyms where reasonably necessary for maintenance, repairs, refurbishment or other operational requirements. In addition, certain gym equipment may be made temporarily unavailable by us, including where equipment is undergoing inspection, maintenance or repair, is being replaced, or has otherwise been taken out of use for operational or safety reasons. We will seek to minimise any disruption and, where reasonably practicable, provide you with advance notice of any planned closures or restrictions.
9.11 We may send push notifications through the App during periods of planned maintenance, updates to our membership system, or unexpected service interruptions. Where access to the App is temporarily unavailable, we will provide you with a pin access code to access the gym where applicable. We recommend that you have push notifications enabled on your mobile devices to ensure you are aware of any ongoing issues, and to allow you continued access to our gyms.
9.12 As part of our facilities at each of our gyms, we provide single-sex communal changing rooms for males and females (based on biological sex), alongside private, individual-use, accessible, and gender-neutral facilities. We are committed to treating all of our members with dignity and respect, and we expect that all of our members treat other members in the same manner. A copy of the changing policy can be found in the following link https://nrggym.com/changing-rooms-policy/. Should you have any questions, concerns or issues, these can be raised with a member of our gym staff.
10. Payment
10.1 If you are a Monthly Member, you agree to pay the joining fee (if applicable) along with the first monthly fee upfront and a rolling payment of the monthly fee with no ongoing contract, but the relevant notice period required as laid out in the Cancellation Period Section of this document.
10.2 You must inform us of a Promotional Code on sign up. You agree to pay the Promotional Code rate applicable to your joining fee and/or monthly fee for the period of that Promotional Code. After that period has ended, we can then debit the normal monthly fee in respect of following months until your membership is ended.
10.3 We will continue to debit all monthly fees even if you do not attend the gym or use the Services, except where access is unavailable for a prolonged period, without affecting your statutory rights. Other than during an emergency, where there are occasions when we must close all, or certain parts, of the gym, we will provide reasonable notice in advance and will use reasonable endeavours to ensure that such closures are during quiet periods.
10.4 If any payment due from you is not received or a direct debit is not honoured for any reason, you may be liable to pay an administration fee of up to £25.00.
10.5 We may change the monthly fee for Monthly Members from time to time to reflect increased operating, regulatory or other business costs. We will give you at least 14 calendar days' notice after which the new monthly fee will apply. You may cancel your membership before the changes take effect without penalty. If your initial monthly fee was part of any offer or Promotional Code, your monthly fee will be charged at the agreed promotional period and will then automatically change to the regular monthly fee at the end of the promotional/offer period.
10.6 If you fail to pay any amount due under this Contract for a period of more than 30 days, then we may cancel your Contract and pass this debt to a third-party collection agency for collection. All reasonable costs incurred in the collection of this debt (including tracing you) by the collection agency shall be borne by you.
10.7 We reserve the right to end any Promotion and/or Promotional Code without warning at any time on a prospective basis, which will not affect discounts already applied during a confirmed promotional period.
11. Membership Freeze
11.1 You can freeze your membership at any time, for any reason, for a minimum of 1 month, providing you give 30 days’ notice by email. You can freeze the membership for up to 3 months (the “Freeze Period”). You may only request 1 Freeze Period in any 12 months’ period.
11.2 You may freeze your membership for up to three consecutive months.
11.3 Cancellation notice period and Freeze Periods cannot run concurrently.
12. Cancellation Period
12.1 If you sign up to a membership, you have the right to cancel this Contract within 14 days of completing your sign-up process without giving any reason as a “Cooling Off Period”. To do so you must inform us by email to the management team of the gym (nrggym.com/contact/). You must send your cancellation request before the Cooling Off Period expires.
12.2 If you cancel within the Cooling Off Period without accessing the gym, you may be eligible for a refund upon request of the joining fee (if applicable) and any other membership fees you may have paid and your access to the gym will end. Access to the gym will be terminated instantly.
12.3 If you cancel within the Cooling Off Period and have entered the gym then you will be charged a proportionate amount reflecting the day pass rate for Services used up to the point of cancellation, capped at one month's membership fees. Your access to the gym will end at the point of cancellation.
12.4 Outside of the Cooling Off Period, you must complete the minimum term of your membership (the “Commitment Period”) before a cancellation request can be processed.
12.5 After completion of the Commitment Period, you must give a minimum of 30 days’ notice of cancellation. Any payment due within the 30 days' notice period will be due in full and not a pro rata amount. If you pay your membership via direct debit, this will be collected on the same day of each month as the date you signed up to your current membership. Any notice period to cancel your current membership after completion of the Commitment Period will be calculated by reference to the first recurring direct debit payment date which falls beyond the minimum 30 days' notice period.
12.6 For Monthly Members this means your initial minimum membership term will be 60 days (comprising a 30-day Commitment Period and a 30-days' notice period)
13. Contract Termination By You
13.1 Once the relevant Commitment Period has expired you may only terminate this Contract in the following ways:
(a) If you are a Monthly Member, you can cancel your membership by emailing us and upon confirmation from our Customer Service team, we will do the work for you, including cancelling your direct debit or recurring card payment if it hasn’t already been requested from your bank. (Cancelling your direct debit at the bank will not close your account, the account will remain live and may incur debt if a new payment method is not added).
(b) Cancellation notice cannot be placed whilst an account is in a Freeze Period. If a cancellation is requested during a frozen period, the final payment will be due on the next regular payment date following the end of the Freeze Period.
14. Contract Termination By Us
14.1 We may terminate this Contract with immediate effect for a valid reason, including if you:
(a) Are in breach of any part of the Terms, Gym Rules or House Rules;
(b) If a membership fee is unpaid for 30 (thirty) days (or more);
(c) We reasonably believe that the circumstances in your Medical Health and Fitness Declaration have changed or are incorrect and you have not updated us;
(d) If the staff at your site reasonably believe your behaviour (including complaints from other members) is not of the standard expected of a member;
(e) We reasonably believe that you have willingly allowed any other person to use your pin access code or mobile device to access the site; and / or
(f) Further and in the alternative, we reserve the right (at our reasonable discretion) to suspend and/or terminate your membership if you breach these Terms.
14.2 Please read these terms of use carefully before you start to use the site. By using our site, you indicate that you accept these terms of use and that you agree to abide by them. If you do not agree to these terms of use, please refrain from using our site.
15. Suspension
15.1 We may suspend your membership where it is reasonable for us to do so, including in situations where:
(a) you have breached these Terms, the Gym Rules or House Rules;
(b) we are investigating a suspected serious breach of these Terms;
(c) you have failed to pay any additional fees properly applied under these Terms; and
(d) you have engaged in behaviour which may pose a risk to the safety, wellbeing or enjoyment of other members or our staff.
15.2 We will notify you of the reason for the suspension and, where appropriate, the steps you must take before your Membership can be reinstated
15.3 During any period of suspension, we will inform you whether your Membership payments will continue or be paused, taking into account the reason for suspension and the circumstances of the case. Where payments are paused, they will recommence on your next scheduled payment date following reinstatement of your Membership unless we notify you otherwise.
15.4 If you are an Annual Member and your membership is suspended, your membership will continue to run during the period of suspension, and the expiry date of the membership will not ordinarily be extended. We will, however, ensure that we act reasonably in determining the duration of any suspension, having regard to the nature and seriousness of the breach. We may, at our discretion, extend your membership period where we consider it appropriate to do so.
16. Additional Fees
16.1 We may apply a reasonable one-off additional fee where this is proportionate to do so in the circumstances and reflects the costs reasonably incurred by us as a result of your actions. We will notify you of:
(a) the reason the fee has been applied;
(b) the amount payable;
(c) the date of the relevant incident; and
(d) the date by which the payment must be made.
16.2 This may include, but is not limited to, the following situations:
(a) A charge of £200 may be applied where you deliberately use a fire exit other than in a genuine emergency. This charge reflects the reasonable costs incurred by us, including any alarm response, investigation and administrative costs associated with such misuse.
(b) We may apply a reasonable additional fee where appropriate, or issue a warning or suspend your Membership in cases of repeated or serious breaches including:
(i) pod sharing;
(ii) repeated weight slamming
(iii) repeated failure to re-rack equipment;
(iv) damage to our equipment or property; or
(v) Fees associated with the cost of repairing or replacing any property you damage whilst using our gyms.
16.3 You must wear suitable gym attire when using our gyms, and we expect our members to comply with the attire requirements as set out in our House Rules. If you fail to comply with our attire requirements when using our gyms and facilities, a member of our staff may ask you to change your attire to align with our House Rules before using, or continuing to use, our facilities.
16.4 We will notify you in writing of any one-off additional fee applied to your account. Any such fee must be paid within 14 days of the date of notification. If you fail to pay the fee within that period, we may suspend your Membership until all outstanding additional fees have been paid.
17. Appeals
17.1 Where a one-off additional fee is applied to your account, you may appeal this fee with us within 14 days of the date of notification of the fee being applied. Any appeal should be submitted in writing by providing this either to our reception staff, or by submitting your appeal by using the email addresses for each of our gyms as outlined on the Website (nrggym.com/contact/). You should provide reasonable details of the grounds for the appeal, together with any relevant supporting information.
17.2 Your appeal will be considered by either our gym manager or our head office. We will reasonably consider your appeal and will take into account:
(a) the circumstances giving rise to the one-off fee; and
(b) any relevant supporting information provided by you.
17.3 Once your appeal has been considered by us, you will be informed of the outcome as soon as reasonably practicable. If your appeal is successful, we will remove the relevant fee from your account. If your appeal is unsuccessful, your outstanding fee shall be payable to us within 14 days from the date which we notify you of your appeal's outcome.

18.3 You must not use our IPR in any manner that is misleading, defamatory, brings us into disrepute, or suggests any form of endorsement or association without our prior written approval.
18.4 You may print off one copy, and may download extracts, of any page(s) from our Website and/or App for your personal reference.
18.5 You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
18.6 Our status (and that of any identified contributors) as the authors of material on our site must always be acknowledged.
18.7 You must not use any part of the materials on our Website or App for commercial purposes without obtaining a licence to do so from us or our licensors.
18.8 Any unauthorised use of our IPR may result in suspension or termination of your membership and may give rise to legal action. You must, at our option, return or destroy any copies of the materials you have made.
19. Our site changes regularly
We reserve the right to update our Website regularly and may change the content at any time. If the need arises, we may suspend access to our site or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.

(i) loss of income or revenue;
(ii) loss of business or business opportunities;
(iii) loss of profits or contracts;

(vi) loss of goodwill;
(vii) wasted management or office time; and
(viii) for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to your tangible property or any other claims for direct financial loss that are not excluded by any of the categories set out above.
21. Theft, Loss or Damage
21.1 We recommend that you do not bring valuable, irreplaceable or unnecessary items into our gyms. Where lockers are provided in our gyms, we recommend that you should keep such belongings in a locker, secured with a padlock at all times. 21.3 If any of your personal belongings, property or gym accessories are lost, stolen or damaged whilst at one of our gyms, you should report the incident to a member of our staff as soon as reasonably practicable and provide us with any information reasonably requested to assist us in investigating your matter. Where appropriate, we may investigate reported incidents, including reviewing available CCTV or other relevant information available to us. Any investigation undertaken by us does not, in itself, constitute an admission of liability or responsibility for any loss, theft or damage.
21.4 We cannot guarantee that CCTV footage or other relevant information which can be used to investigate a reported incident will be available, retained or disclosed. Our ability to access and use such CCTV footage or other relevant information may be subject to applicable law, our policies, and the rights of other individuals whose personal data may be contained within such information.
21.5 You are responsible for any reasonable losses or damages caused by you or by any person you knowingly allow to access our gyms or facilities by using your Membership, access code, mobile device or by other means of entry (notwithstanding the fact that allowing any person to access our gyms or facilities in this way is in breach of these Terms), where such losses or damages results from:
(a) a breach of these Terms;
(b) misuse of our facilities or equipment;
(c) your negligence; or
(d) failure to comply with our Gym Rules or health and safety requirements.
21.6 Where losses or damages occur in the circumstances outlined in clause 22.5 of these Terms, we may seek reasonable compensation for the losses or damages suffered by us from you and, where reasonable and proportionate, we may suspend or terminate your Membership in accordance with these Terms.
